It Was Never About Choice

Here's my latest column at the Partial Observer, about Roe v. Wade.

  1. Great article, JL. As I see it though, to overturn Roe at this point would not be a nod to federalism. Rather, we would see federal legislation to regulate or ban abortion. The religious right cannot tolerate abortion anywhere, and as we have seen with the issue of gay marriage, they will seek to federalize the issue.

    Sadly, federalism is all but dead, and it is completely dead as a consistent principle of constitutional jurisprudence. All we get now are hypocritical federalists who seem to argue that "the states have the right to do those things that we approve of but not those things that we disapprove of".
